VR WAVE Terms and Conditions for Purchase of Third-Party Prescription Lenses
By purchasing third-party prescription lenses from VR WAVE, you ("Customer") are automatically deemed to have read, understood, and agreed to the following Terms and Conditions without the need for additional verification. These terms are designed to clarify the nature of the products offered by VR WAVE and to protect VR WAVE from any liability related to intellectual property claims or misuse of brand affiliations.
1. Nature of Products
VR WAVE manufactures and sells third-party prescription lenses designed to be compatible with certain smartglasses and virtual reality devices, including but not limited to those produced by Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, and Valve. These lenses are independently produced by VR WAVE and are not manufactured, endorsed, sponsored, or affiliated with Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or any of their affiliates. VR WAVE’s products are aftermarket accessories intended to enhance the functionality of compatible smartglasses or virtual reality devices by providing prescription lens options.
2. Conclusion of Contract
Adding products to the cart is non-binding, and you may update your order at any time before confirming payment. The contract becomes effective upon confirmation of payment through our payment gateway. Registration is not required to place an order. Order confirmations are sent via email, and previous orders cannot be accessed online. These Terms and Conditions are available on our website at any time.
All prices are non-binding and subject to change. The prices applicable at the time of order placement will apply. Despite our efforts to ensure accuracy, VR WAVE’s website may contain typographical, technical, informational, or other errors. In such cases, the Customer may contest the contract. VR WAVE assumes no liability for third-party information, such as manufacturer descriptions.
VR WAVE strives to improve its products continuously, and product images may slightly differ from the delivered product. All products remain the property of VR WAVE until all contractual obligations, including full payment, have been fulfilled.
3. No Affiliation with Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or Other Brands
Customer acknowledges that VR WAVE is an independent company and is not affiliated with, authorized by, or partnered with Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or any of their subsidiaries or affiliates, or any other smartglasses or virtual reality device manufacturers. VR WAVE does not use, reproduce, or claim any rights to the trademarks, trade names, logos, or other intellectual property of Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or other brands in the manufacture, sale, or marketing of its third-party prescription lenses. Any reference to Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or other brands is solely for the purpose of indicating compatibility and is not intended to suggest endorsement, sponsorship, or affiliation.
4. Intellectual Property Disclaimer
Customer understands and agrees that VR WAVE’s third-party prescription lenses are designed to fit specific smartglasses or virtual reality device models but do not incorporate or infringe upon any patented technology, trade secrets, or other proprietary rights owned by Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or their affiliates, or other manufacturers. VR WAVE disclaims any liability for claims of intellectual property infringement arising from the use, sale, or distribution of its products. Customer assumes all responsibility for ensuring that their use of VR WAVE’s lenses complies with applicable laws and does not infringe upon the intellectual property rights of third parties.
5. Customer Acknowledgment
By purchasing VR WAVE’s third-party prescription lenses, Customer acknowledges and agrees that:
· The lenses are not original equipment manufacturer (OEM) products from Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or any other brand.
· VR WAVE does not represent, warrant, or imply that its lenses are approved or certified by Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or any other entity.
· Customer is solely responsible for verifying the compatibility of VR WAVE’s lenses with their smartglasses or virtual reality devices and for any consequences arising from their installation or use.
· Customer will not hold VR WAVE liable for any legal action, including but not limited to intellectual property claims, initiated by Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or any third party related to the purchase or use of VR WAVE’s products.
6. Shipping
Shipping Costs
The exact shipping costs depend on the shipping address and are displayed during checkout before the order is finalized. Orders to international destinations may incur import duties and taxes upon arrival, which are the responsibility of the Customer.
Delivery Time
Orders are dispatched as soon as possible, within three weeks from receipt of payment. The three-week production period concludes upon dispatch, marked by the postmark date. Customers may legally withdraw from the contract if the order is not dispatched within this period. VR WAVE is not liable for delays caused by payment institutions or transport companies.
7. Payment
Payment method availability varies by country. Once the payment gateway confirms successful payment, production begins, and the order cannot be withdrawn. All payments must be made in USD.
8. Right of Withdrawal
As prescription lenses are custom-built based on Customer-provided specifications, withdrawal from the contract is not permitted if the delivered product is flawless. If the produced lenses do not match the provided specifications, VR WAVE will correct them. Variations up to 10° in axis and ±0.25 diopters are within manufacturing tolerances and do not warrant correction. If VR WAVE is responsible for incorrect values, correction costs are covered by VR WAVE; otherwise, the Customer bears the correction costs.
9. Warranty
Quality flaws must be reported immediately. If subsequent fulfillment incurs disproportionately high costs, VR WAVE reserves the right to refuse it. Refunds for valid claims will be issued only after the return of the defective products. For valid claims, postage will be refunded based on Deutsche Post’s price list. Postage for invalid claims is not refunded.
10. Limitation of Liability
To the fullest extent permitted by law, VR WAVE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to claims of intellectual property infringement, loss of profits, or damage to smartglasses or virtual reality devices, arising out of or related to the purchase, installation, or use of VR WAVE’s third-party prescription lenses. VR WAVE’s total liability to Customer shall not exceed the purchase price of the lenses.
11. Indemnification
Customer agrees to indemnify, defend, and hold harmless VR WAVE, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to Customer’s use of VR WAVE’s lenses, including but not limited to any claims of intellectual property infringement brought by Meta, Ray-Ban, Apple, Pimax, Xreal, DJI, HTC, PlayStation, Pico, HP, Valve, or any third party.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved exclusively in the courts of the Hong Kong Special Administrative Region, and Customer consents to the jurisdiction of such courts.
13. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms and Conditions constitute the entire agreement between Customer and VR WAVE with respect to the purchase of third-party prescription lenses and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
By completing your purchase, you are automatically deemed to have read, understood, and agreed to be bound by these Terms and Conditions without the need for additional verification.
